Very astute in my opinion. You will not get straightforward answers from publishers who want to sell you their product. Publishers online homework systems are notoriously inaccessible. And chemistry and math are some of the more challenging subjects to make accessible. We did a quick screen reader test with OWLv2 and found that the Try another version button wasn't accessible. It also was difficult for our screen reader user/tester to get from the question link to the content part of the page, but that's more of a usability issue. We tried testing WebAssign but never could get the screen reader set up in the way they claimed would make it read the equations and notations correctly. And what it could read, couldn't be read one character at a time, making it very difficult for a student who is blind to study the equation. I'm not familiar enough with the other products specifically, but I am familiar with other products from the same companies and would guess that they aren't any further along accessibility wise. I would also urge you to ask about the accessibility of the textbook content as that is what the homework system will use. The images should have sufficient alt text and equations and scientific notation should be in MathML. Our Chemistry instructor who teaches online likes Cengage Owlv2, so she is working with the Cengage folks to make the areas we found to be inaccessible, accessible or to develop accessible alternatives. They have a MyChemistryLab and MyMathLab. They have made incredible progress creating accessible programs (not all are completely accessible yet but they continually working to make it happen). We have a student who is deaf-blind that will be taking Accounting and Finance courses in the fall semester. I have been working with Pearson for a couple of years regarding accessibility. If you are a DNS user and your institution uses Duo two factor authentication to access secure websites, the Dragon browser plug-in has a conflict with Duo and will not load the secure sites unless the plug-in is disabled, rendering Dragon useless. We?ve tested this in Windows 7 (32 and 64 bit) as well as Windows 10. It happens with Chrome, Firefox and IE 11. It does not seem to be a problem if using Dragon for Mac with Duo. Please let me know if you use Duo and have encountered this problem, or if you have a contact at Nuance that I could escalate this to. To put this court decision in context: Many campuses across the country have received letters from a law firm alleging that an individual with a disability has been harmed due to lack of compliance with WCAG standards for accessibility on campus webpages. What the case discussed below makes clear is that the individual filing the complaint must actually suffer "concrete harm." In other words, in the case of these letter threatening litigation, the issue is not just whether or not your webpages pass an automated accessibility check; the issue is whether the inaccessible areas of the website actually had a concrete (as opposed to theoretical) negative impact on the user's ability to navigate the site and interact with all the required elements. I recommend sharing this case with the legal counsel representing you if you have received one of these letters. This decision gives your legal counsel another line of argument, as well as case law to which to refer. Just to be clear, you still need to do your due diligence to ensure website compliance with accessibility standards. The letters threatening legal action are a wake-up call that all campuses assume potential risk by not making all of the content on their webpages (especially those pages, forms, and learning objects that students and staff must interact with) fully accessible. This court decision may take a bit of the pressure off, however, for those of you dealing with the fear of litigation. A sharp increase in the number of ADA Title III lawsuits has followed these decisions. The U.S. Supreme Court's May 16, 2016 decision in Spokeo, Inc. v. Robins may impact how courts across the country interpret standing requirements for these cases in the future. Although not an ADA case, lower courts may apply Spokeo to reign in the recent growth of Title III litigation. In Spokeo, the plaintiff filed a putative class action against a company that operated an online background search service. In the complaint, the plaintiff alleged that information provided about him in a background report, such as his marital status, age, and education, was inaccurate. The plaintiff, on behalf of himself and a class of similarly situated individuals, charged the company with willfully violating the Fair Credit Reporting Act (FCRA) by failing to adopt procedures to ensure the accuracy of its reports. The Ninth Circuit held that the complaint in Spokeo sufficiently alleged an injury-in-fact as required for standing, but the Supreme Court vacated the Ninth Circuit's decision, and remanded the case. In a majority opinion by Justice Alito, the Court held that the Ninth Circuit's standing analysis was incomplete because it failed to consider whether the alleged injury was sufficiently "concrete." To qualify as a "case or controversy" over which a federal court has jurisdiction, according to the Court, there must be a concrete injury, meaning it must "actually exist", and be "real" rather than "abstract." The problem with the complaint in Spokeo, the Court reasoned, was that a violation of the FCRA's procedural requirements may result in no harm. The Court directed the Ninth Circuit to consider on remand "whether the particular procedural violations alleged . . . entail a degree of risk sufficient to meet the concreteness requirement." This case raises interesting questions for ADA Title III matters where standing can be a hotly contested issue: * Does an ADA "tester" who travels to businesses, not to purchase goods or services, but instead solely to evaluate compliance, suffer "concrete" injury as clarified in Spokeo? * Do ADA plaintiffs have standing to challenge all barriers at a business related to their disability, or only those that they actually encountered during their visit? * Does a serial ADA plaintiff's litigation history have any bearing on whether he or she suffered "concrete" injury in a given case? Although the implications of Spokeo for ADA Title III cases are not entirely clear at this point, the decision is good news for businesses. Some ADA Title III plaintiffs have only the most tenuous connection to the businesses they sue, and the alleged barriers that they challenge. Spokeo may prompt lower courts to more carefully scrutinize whether their alleged injuries are sufficiently "concrete" to confer jurisdiction in federal court. And there weren't that many deficiencies. We have found Salesforce to be very responsive to our accessibility concerns, especially for the things we could not address ourselves. Personally, I can't think of another company that has been as easy to work with. Salesforce is in many ways more of a development platform than a ready-to-use product, so you will want to do baseline testing so you know where the problems are and make decisions about how to address them as you put it together for your purposes. sb Sarah E. Our department recruits paid note-takers to students that qualify for the accommodation. These note-takers are usually co-students in the same class. We currently have them give a copy of their notes to the student with the disability, usually in the form of a photocopy or carbon copy. We are looking into the possibility of using other technology options: e.g., having the note-takers use Smart Pens, AudioNote, Sonocent, and other "higher tech" note-taking methods. But, we are cautious with how to pilot and test this initiative. And, the learning curve for MAGic and JAWS is considerably less time than moving from ZoomText to JAWS for some users, because the keystrokes in MAGic mimic those of JAWS. With that said, I don't know which software, ZoomText or MAGic, your state resources (ours is Texas D.A.R.S.) start out teaching new V.I. but in Texas (Harris County, Houston) area it's been defaulted to ZoomText and then if the consumer's vision worsens to having to go to JAWS, they teach JAWS. Some of the D.A.R.S. counselors will ask a consumer if they want to learn MAGic, kinda being proactive in case, or ZoomText, but not always do they give a choice. Now, again with that said, I have successfully installed JAWS, MAGic, and ZoomText on several computers over the past 15 years with no problem AS LONG AS I INSTALL JAWS AND MAGic FIRST then install ZoomText. She is currently taking a class that requires her to reference several images and graphs in the book to duplicate work. Her issue is that even with Zoomtext, she is still unable to decipher lines and some other fonts within the image. The problem isn?t the magnification of the images, it?s more the resolution. I thought I would give more detail in hopes of getting some feedback. I have a vision impaired student that is currently taking a graduate class that heavily relies on statistics. She uses the Zoomtext magnifier/screen reader to assist her in the course. There are exercises that she must complete as homework that make reference to several charts and graphs in the text (she has the e-text). Of course the screen reader on Zoomtext will not read the charts and graphs. This student?s vision impairment impacts the detail and resolution of things she?s viewing. So when she looks at the graphs, in particular, she?s not able to see any fine lines and/or the contrast of shading in the graphs. Additionally, the more the image is magnified, the less resolution and sharpness she can see. This is making it difficult for her to complete her assignments. Have you ever run across something like this? This student is taking this course online, so it?s difficult to get her physical one on one assistance in reading the graphs. However, one of my VI students really likes visual representations which makes it difficult. We have gone low tech with her and many of her professors are following suit and doing the same. She brings her rolls of poster paper to class and when others are looking at smaller maps she opens hers up and spreads it out and is able to keep up with class discussions. We recently discovered we are third in the nation for transferring students to 4-year colleges and universities. In the summer of 2017, Moorpark College will be celebrating 50 years. Moorpark College is located about 15 miles north of Thousand Oaks via the 23 freeway which turns into the 118. Thousand Oaks is situated right between L.A. and Santa Barbara in S. California. The college is one of 3 which comprise the Ventura County Community College District. The other two are Ventura College and Oxnard College. Moorpark College is nestled at the base of the Simi Valley foothills. Despite the drought, our college has maintained a very beautiful appearance and visitors always comment on the beauty of the campus and its landscaping. There are approximately 14,000 students registered at Moorpark College, and the ACCESS program serves 1,300. The administration at Moorpark College is very supportive, and no matter who the president was at any one time, ACCESS has always been fully supported. The campus motto is "Students First", and it is a great pleasure to work with all of the staff (classified, instructional, and management). I will dearly miss all of the people on our campus. The ACCESS program has a classified staff of staff of 5. There are two full-time LD Specialists and two part-time LD Specialists. There is one full-time DSPS Academic Counselor and one part-time Academic Counselor. The Coordinator position is full-time, 11 months. We also have two provisional staff members who work about 20 hours per week from August to May. Granted that getting interpreter may be the best but often these stuff is so short notice and travel expense of interpreters is bit too excessive for us." I'm not sure why he needs the stuff read out loud except that he must have colleagues who are not able to read a computer screen for whatever reason (on the phone in a car possibly). And chemistry and math are some of the more challenging subjects to make accessible. We did a quick screen reader test with OWLv2 and found that the Try another version button wasn't accessible. It also was difficult for our screen reader user/tester to get from the question link to the content part of the page, but that's more of a usability issue. We tried testing WebAssign but never could get the screen reader set up in the way they claimed would make it read the equations and notations correctly. And what it could read, couldn't be read one character at a time, making it very difficult for a student who is blind to study the equation. I'm not familiar enough with the other products specifically, but I am familiar with other products from the same companies and would guess that they aren't any further along accessibility wise. I would also urge you to ask about the accessibility of the textbook content as that is what the homework system will use. The images should have sufficient alt text and equations and scientific notation should be in MathML. Our Chemistry instructor who teaches online likes Cengage Owlv2, so she is working with the Cengage folks to make the areas we found to be inaccessible, accessible or to develop accessible alternatives. OCR had received complaints involving each of the organizations, resulting in investigations. But before OCR had completed its probes, each of the 11 parties expressed interest in resolving their cases voluntarily, resulting in the agreements announced today. The settlements involved: Juneau, Alaska, School District; the Guam Department of Education; Montana School for the Deaf and Blind; Santa Fe, New Mexico, Public Schools; Washoe County, Nevada, School District; The Davidson Academy of Nevada; Nevada Department of Education; Oregon Department of Education; Granite, Utah, School District; Bellingham, Washington, School District; and the Washington Office of Superintendent of Public Instruction. "As schools, school districts, states, and territories turn to the internet as a way to provide relevant and up-to-date information to their audiences in a cost-effective manner, they must make sure they are not inadvertently excluding people with disabilities from their online programs, services, and activities," said Catherine E. Lhamon, assistant secretary for civil rights. "I applaud each of these signatories who have committed to ensuring that their websites are accessible to people with disabilities." The agreements cover issues raised under Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act of 1990 to online services and programs. OCR investigations found that on all 11 websites important images were missing text descriptions, called "alt tags," that describe the images to blind and low-vision users who use special software. Common problems affecting many of the websites included: . Some important content of the website could only be accessed by people who can use a computer mouse, which meant that content was not available to those who are blind, many who have low-vision, and those with disabilities affecting fine motor control; . Parts of the website used color combinations that made text difficult or impossible for people with low vision to see; and . Videos were not accurately captioned, so they were inaccessible to people who are deaf. The 11 education groups voluntarily committed to make their websites accessible through a range of actions, which require OCR review and approval at key stages, including: . Affirming their commitment to ensuring that people with disabilities have opportunities equal to those of others to enjoy the recipients' programs, services, and activities, including those delivered online; .
