[Athen] Fwd: Advocates File Suit on Education’s Case Processing Changes

Yesterday (5/31/18) three advocacy organizations, The National Federation of the Blind, The Council of Parent Attorneys and Advocate and the National Association for the Advancement of Colored People, filled suit against the U.S. Department of Education over changes in the department's case processing polices. The suit claims that changes in the processing manual are incongruent with OCR's mission and neglect its obligation to investigate complaints of disability and race-based discrimination in the nation's schools. Denise Marshall, executive director of the Council of Parent Attorneys and Advocates said that the new case processing manual released last March has summarily eliminated substantive rights of students.; "With this arbitrary and capricious action OCR has abandoned its basic duty to investigate legitimate complaints of discrimination by students with disabilities and their parents."

The U.S. Department of Education has stated that the changes are necessary to effectively manage limited resources by allowing OCR to dismiss complaints if they're part of a pattern of similar complaints filed by an individual or a group.
