That statement isn't bad... I would add something to the effect of COMPANY acknowledges and warrants that their products and services are currently in compliance and during the Term of this Agreement shall remain in compliance with all applicable Federal and Washington State disabilities laws and regulations "and will promptly correct any aspects found to be out of compliance."

Hi all,

I want to gather examples of technical accessibility compliance statements to insert into an RFP document for my agency. We are working to identify a Student Success and Advising software solution for our 34 colleges and that will integrate into our existing system application as well.

What statements are you using??

Included is an example Accessibility Contract Rider that I may end up tweaking to be appropriate for the RFP process. Additionally, we plan to ask each vendor to complete the 1Ed Tech Accessibility Rubric<https://www.1edtech.org/standards/accessibility-rubric>, provide us with a product demo illustrating accessibility, and will do our own functional testing for the top two solutions.

SBCTC Accessibility Rider Example
In accordance with Section 504 of the Rehabilitation Act of 1973, the <https://www.ada.gov/pubs/adastatute08.htm> Americans with Disabilities Act of 1990 (ADA)<https://www.ada.gov/pubs/adastatute08.htm> as amended, SBCTC is obligated to provide access to its programs, activities, and services to people with disabilities.
SBCTC must ensure that its IT products, programs, and services are accessible to people with disabilities in accordance with <https://ocio.wa.gov/policy/accessibility> Washington State Policy 188<https://ocio.wa.gov/policy/accessibility>. "Accessible" means to provide substantially similar functionality, experience, ease of use, and information access to people with disabilities as is provided to people without disabilities.
COMPANY acknowledges and warrants that their products and services are currently in compliance and during the Term of this Agreement shall remain in compliance with all applicable Federal and Washington State disabilities laws and regulations.
On an annual basis OR at the time of product renewal, COMPANY will provide SBCTC with a completed Accessibility Compliance Report (ACR) documentation as assurance and verification of the status of accessibility conformance to WCAG 2.1AA technical standards for all of COMPANY'S products covered by this contract. Parties agree that the current Voluntary Product Accessibility Template (VPAT) document at version level 2.3 or higher (available at <https://www.itic.org/policy/accessibility/vpat> https://www.itic.org/policy/accessibility/vpat) will satisfy this requirement. SBCTC may complete internal functional testing as well as independent/third-party accessibility assessment of the accessibility of COMPANY'S works at any time, but will not be held responsible for doing so.
